The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Teddy Bear Pools & Spas reserves the right to accept or decline any order, or to limit the order quantity on any item and/or refuse service to any customer. In the event that we, Teddy Bear Pools & Spas, declines, limits or modifies your order, we will attempt to contact you using the email address you provided. In the event we cancel an order or a part of an order that you have already been charged for, we will refund you the full amount of the canceled portion of the order. Verification of information may be required prior to the acceptance of any order.
You are responsible for, and agree to pay promptly, for all your purchases and charges to your account, including applicable taxes. You shall be responsible and liable for any fees, including attorneys' fees and collection costs, that Teddy Bear Pools may incur in its efforts to collect any unpaid balances from you. If payment cannot be charges to your credit card or a payment is returned to for any reason, including chargeback. Teddy Bear Pools reserves the right to suspend or terminate your access to the Site, including your customer account.
Your credit card information will be encrypted through the software and decrypted when it reaches us. Software is securely encrypting information sent from your Web browser to our web site as well as information sent from this web site to your browser. For more information on security, check your browser's Help screen.
Redeeming Coupons & Discounts
If you have an applicable coupon code, it must be entered at the time of purchase online in the coupon section. We are unable to apply discounts after an order has been placed.
Massachusetts sales tax (6.25%) is applied to all taxable items on orders from MA. Connecticut sales tax (6.35%) is applied to all taxable items on order from CT.
After an order is placed, additional products can not be added to the order. You will have to place an additional, separate, order, and incur any additional shipping charges. Orders placed within the same day to the same customer and same shipping address may be shipped together. Teddy Bear Pools can not guarantee the orders will be shipped together.
In limited circumstances, we may be able to cancel orders if they have not shipped. We can not guarantee that cancelation requests will be honored. Teddy Bear Pools is not responsible for shipping costs incurred to return product back to us.
After an order has been shipped, order(s) can no longer be cancelled. You may return your order in accordance to the Return Policy, see below. Customer assumes responsibility for any shipping costs for returning products.
Shipping & Handling
Teddy Bear Pools & Spas reserves the right to ship product via the best way available whether it be UPS or USPS due to product variations in size, shape and weight. Requested shipping method by customer may not always be used. Teddy Bear Pools & Spas is not responsible for delays in shipping due to alternate methods used and no refunds will be issued to customer for delays in shipping.
Shipping & Handling Cost
There is a $4.99 handling fee applied to all orders. Items ordered together may be shipped separately, but only one handling fee will be charged per order.
Shipping subject to method of shipping selected (USPS or UPS GROUND) and actual weight of product.
Shipping Cost Outside Of the United States
Teddy Bear Pools & Spas Web site and US retail businesses are operated within the continental US for customers within the US and therefore do not ship or bill to international addresses. Teddy Bear Pools & Spas delivers to street addresses (not P.O. Boxes or APO/FPO) in the continental US only.
Delivery of Services
You order(s) will be shipped to the address designated by you. Orders may arrive in multiple packages and on separate days depending on type of and volume of product ordered. Teddy Bear Pools shall not be liable for delays or prevention of delivery due to unforeseen circumstances, or acts of God, which may include, but not limited to, weather conditions, traffic conditions, and/or mechanical difficulties.
What if a product is on backorder?
If a product is on backorder or out of stock, please check back at a later date to see if it is in stock.
How long will it take for my product(s) to arrive?
In-stock orders placed Monday-Friday by 2pm EST are typically shipped within 24 hours of receiving the order. Liners may take up to 10 business days to be shipped. Shipping time varies based off shipping method. Orders placed after Thursday at 12pm EST and shipped via UPS may not leave our store until the first business day of the following week. Holiday & closures due to inclement weather may cause delays in processing time.
UPS 2nd Day Air & UPS 3 Day Select Shipping:
Standard processing time still applies when selecting these shipping methods. Orders placed after Thursday at 12PM EST using UPS 2nd Day Air or UPS 3 Day Select may not leave our facility until the first business day of the following week and will arrive within 2-3 business days depending on the method selected.
Teddy Bear Pools & Spas does not assume responsibility for delays in delivery caused by the carrier. We will not issue shipping refunds for shipping delays.
Delivery time of custom orders will be estimated at the time you receive your quote.
Express shipping may not always be available. If available, it will appear as a shipping option at checkout.
Oversized Delivery Items
Oversized items will not be available for purchase on our website.
Returns & Exchanges
A Return Authorization is required for all returns. Returns received without a return authorization will be refused or promptly returned at your expense. Please email us at [email protected] to receive you RA# or for questions regarding returns or our return policy. RA# may take up to 5 business days.
You may return most products (in new condition) within 30 days of the purchase date for a refund of the purchase price less a 20% restocking fee. Returned products MUST be in original packaging and UNUSED. Sales tax will be refunded, if applicable. Items returned due to manufacturers defect are not subject to the 20% restocking fee, but they are subject to verification of defect by the manufacturer.
Returns on pool liners and winter covers will be accepted for manufacturing defects ONLY.
Pool Liners are sold as FINAL SALE Items. Liners are NOT available for return even in new, unopened condition. It is the customers responsibility to ensure they are ordering the correct style, size and height for their pool. Teddy Bear Pools is not responsible for incorrect sizes ordered and will not accept returns or refund for incorrect sizes ordered, even if product is in new, unopened condition.
We are unable to credit you for shipping or handling charges.
Charges for shipping returned products back to us are the customers responsibility. We will exchange or refund your purchase, as you request. Please allow 21 days from the date you return your package for your refund to be credited or your exchange to be completed.

ABOVE GROUND POOL DELIVERY GUIDELINES
We offer shipping on all swimming pool packages and accessories throughout the Continental United States.
We do ship Above Ground Pools to Alaska and Hawaii.
When you order one of our products over the phone or via the internet, you are agreeing that you have read, understand, and agree to our Shipping & Return policy.
Installed above ground pools.
No refunds are allowed.
No returns are allowed.
*Your residence or business must be accessible by a tractor-trailer.
You are not required to pay any additional shipping charges at the time of delivery.
The freight company will be delivering with a hydraulic lift gate truck and will take the product off the truck and place it in your driveway. The fright company is not required to place the product in your desired location.
The freight company will contact you before they deliver your product(s). Please plan ahead to arrange means of getting the product(s) to your desired location.
Please be aware that even with this service, you will still need 2 to 6 people to move the product(s) from the driveway to your desired location.
Receiving Freight: Clear Delivery
Receiving freight can be as easy as sending it if you follow a few steps:
Stay in contact with your supplier to find out when your shipment was shipped, what carrier it was given to, and an approximate arrival date.
When the shipment is delivered, inspect it immediately for obvious signs of damage.
Compare the number of shipping units received to the number listed on the delivery receipt.
Sign the delivery receipt.
The driver will help you receive your shipment and answer your questions.
While the driver is there, compare the pieces of freight you are receiving to the delivery receipt. If condition and quantity of your freight is acceptable, the driver will ask you to sign the delivery receipt. The driver will give you a copy, and take the original signed copy with him/her (as proof of delivery) for his/her employer's records.
A signed delivery receipt with no exceptions, is called a "clear delivery." Clear deliveries mean that there were no shortages or visible damage at the time of delivery.
Any items that are incorrect or missing from your shipment must be reported within 10 calendar days of delivery. It is the buyer's responsibility to inspect any product to ensure nothing is incorrect or missing before beginning installation. Missing or incorrect parts reported within the timeframe stated above will be shipped by ground shipping or freight carrier (whichever applies). If the buyer wants the missing or incorrect parts that can be sent overnighted or 2-day aired, the customer will have to pay the applicable costs for those services.
Returns will be accepted only up to 10 calendar days after the buyer signs for delivery and only under the condition that the buyer arranges for shipping back to Teddy Bear Pools & Spas Direct and pays all applicable shipping charges to and from Teddy Bear Pools & Spas.
The buyer must call before returning merchandise or to cancel an order. All returns are subject to credit minus shipping charges, only after inspection of returned merchandise by Teddy Bear Pools & Spas. All returned merchandise will be subject to a 15-25% restocking fee due to depreciation. Cancellations that have already been shipped will be treated as a return.
NO refunds will be given on installed swimming pools.
